UNIFORM TRUST CODE


The Uniform Trust Code (2000) is the first national codification of the law of trusts. The UTC was approved by the National Conference of Commissioners on Uniform State Laws (“NCCUSL”) in 2000. Minor amendments to the Code were made in 2001 and 2003. Additional amendments are expected to be approved in August 2004. The UTC is essentially model legislation that must be enacted by state legislatures to become the governing law in a state. On issues on which states diverge or on which the law is unclear or unknown, the Code will for the first time provide a uniform rule.
